“Яндекс” пробовали оштрафовать за отказ раскрыть таможне данные о переписке пользователя
“Яндекс” отказался предоставить властям информацию о почте пользователя и оспорил в суде наложенный штраф – на основании нарушения тайны переписки. Привлечь компанию за отказ от сотрудничества пробовала Федеральная таможенная служба. О сути и результатах разбирательства “Коммерсанту” рассказала представитель компании.
В “Яндекс” обратилась Находкинская таможня, которая требовала предоставить “электронные сообщения, включая приложения, отправленные и полученные” с некоего электронного почтового ящика. Таможня приложила постановление Находкинского городского суда, согласно которому “по электронному почтовому ящику, возможно, обсуждались вопросы, связанные с организацией и осуществлением уклонения от уплаты таможенных платежей”.
Представитель “Яндекса” Ася Мелкумова рассказала, что компания отказалась предоставить переписку, так как “в постановлении суда не было указания на ограничение тайны переписки нашего пользователя”. Юридическая служба уточнила, что “Яндекс” предоставляет информацию о пользователях “в том порядке и тех случаях, которые предусмотрены законодательством”, а не для наведения справок.
После отказа мировой судья участка N425 Москвы вынес постановление о привлечении “Яндекса” к административной ответственности за “непредоставление информации в государственный орган” (ста. 19.7 КоАП) и назначил штраф в 3000 рублей. Компания оспорила взыскание в Хамовническом райсуде.
“Это первый случай, когда “Яндекс” попытались привлечь к ответственности за подобный отказ”, – подчеркнула Мелкумова.
Российские компании не предоставляют статистику по запросам от органов власти. Среди зарубежных компаний больше всего запросов в первой половине 2015 года получил Google, и он же стал единственным, кто изредка сотрудничал с органами. Было удовлетворено около 5% обращений. Twitter получил 82 запроса и не удовлетворил ни одного, соцсеть Facebook отказала по единственному запросу.
