В Госдуму внесены поправки для устранения еще одной лазейки, позволяющей выводить деньги за границу
На прошлой неделе в Госдуму был внесен законопроект, направленный на противодействие выводу денег за рубеж. В случае принятия поправок они вступят в силу с момента их официального опубликования.
Законопроект вводит требование для резидентов – участников внешнеторговой деятельности по репатриации на свои счета в уполномоченных банках денежных средств от нерезидентов.
Речь идет о 30,2 млрд долларов, которые, как свидетельствуют данные ЦБ, именно таким образом безвозвратно покинули Россию, пишет газета “Коммерсант”. Именно такова, по данным ЦБ, по состоянию на 1 июня 2015 года, сумма невозвращенных нерезидентами резидентам денежных средств в установленные договорами займа сроки.
Поправки предполагают, что в случае, если резидент РФ не примет меры по обеспечению возврата выданного займа, то на него будет наложен административный штраф в размере вплоть до полной суммы выданных иностранному лицу средств.
Законопроектом устанавливается также административная ответственность за невыполнение резидентом обязанности по репатриации денег.
Опрошенные газетой юристы находят предложенный механизм вполне работоспособным, так как такие механизмы эффективно работают за рубежом.
В настоящее время валютное законодательство не содержит требования о репатриации резидентами на свои счета денежных средств, представляемых нерезидентам в рамках договоров займа, отмечается в пояснительной записке к проекту. Отсутствие такой нормы как раз и используется недобросовестными компаниями для вывода денег за рубеж.
