«Роснефть» подала иск к ФАС
Нефтяная компания «Роснефть» подала исковое заявление к Федеральной антимонопольной службе (ФАС) России. Карточка дела размещена на сайте Арбитражного суда Москвы.
Заявление «о признании решений и действий (бездействий)» недействительным датировано 8 февраля, к производству оно пока не принято. Суть претензий нефтяной компании к антимонопольной службе в материалах суда не раскрывается. Третьих лиц в заявлении не указано.
Пресс-секретарь «Роснефти» Михаил Леонтьев, комментируя РБК иск компании к ФАС заявил, что «очевидно, обнаружился ряд вопросов, по которым мы не можем договориться». «Мы же не в прокуратуру обратились, а в Арбитражный суд. Суд решит. Мы хотим получить правовую оценку наших разногласий. Это нормальная, цивилизованная процедура», — отметил Леонтьев.
Как позже пояснил представитель пресс-службы «Роснефти», в суде оспаривается привлечение компании к административной ответственности в виде штрафа в размере 5 000 руб. за допущенные, по мнению ФАС, нарушения при проведении закупки на отдельные виды работ на месторождениях.
31 января ФАС вынесла предупреждение ПАО «НК «Роснефть» и АО «Газпром газэнергосеть» в связи с нарушениями антимонопольного законодательства, выявленными ведомством «по результатам анализа ценовой ситуации на рынке нефтепродуктов». Антимонопольная служба напомнила компаниям о необходимости реализации на биржевых торгах не менее 10% производимого бензина.
В соответствии с предупреждением компании должны были принять меры по устранению последствий допущенных ими нарушений до 6 февраля 2017 года. «В случае невыполнения предупреждения в установленные сроки антимонопольным органом будет принято решение о возбуждении дела», — говорили РБК в пресс-службе ФАС.
