Материалы по делу последней фигурантки “Оборонсервиса” возвращены в прокуратуру на доработку
Дело последней фигурантки “Оборонсервиса” Екатерины Сметановой, которое суд начал рассматривать 10 февраля, возвращено в прокуратуру для “устранения препятствий рассмотрения его судом”, сообщает ТАСС.
“Дело в отношении Сметановой возвращено в прокуратуру по ст. 237 УПК РФ для устранения недостатков”, – рассказала пресс-секретарь Пресненского суда Москвы Нина Юркова.
Стоит отметить, что Сметанова заключила сделку с правосудием и находится под государственной защитой. Она подписала досудебное соглашение о сотрудничестве и была освобождена под подписку о невыезде. Сметанова активно сотрудничала со следствием, признала вину и дала подробные показания на других фигурантов, в том числе и на Евгению Васильеву.
Она обвиняется по статьям о коммерческом подкупе и мошенничестве (ч. 3 ст. 204 и ч. 4 ст. 159 УК РФ). По данным следствия, Сметанова участвовала в ряде коррупционных схем, связанных с продажей недвижимого имущества Минобороны по заниженной стоимости. За содействие в реализации высвобождаемой недвижимости она систематически получала через посредника незаконное денежное вознаграждение.
Как отмечают “Заголовки”, цитируя российскую прессу, во время допроса Сметанова рассказала, что являлась главой фирмы “Эксперт” (агента, получавшего вознаграждения в размере 5% от сделки по продаже активов Минобороны) только номинально. За свою работу она получала фиксированную зарплату – 300 тысяч рублей в месяц. Реально же компанией руководила ее бывшая сокурсница и подруга – Евгения Васильева.
Напомним, что Васильева 8 мая 2015 года была приговорена к пяти годам лишения свободы и вскоре вышла по УДО. Остальных фигурантов – среди которых был также муж Сметановой – Максим Закутайло – суд приговорил к наказанию от 3,5 до пяти лет в колонии общего режима.
Самой Сметановой вряд ли назначат серьезное наказание. В сентябре 2015 года источник “Интерфакса”, знакомый с ситуацией, отмечал, что судебный процесс в отношении Сметановой пройдет в особом порядке, то есть в ускоренном режиме, без судебного следствия. “Сметанова, скорее всего, получит самый мягкий приговор среди всех обвиняемых по этому громкому делу и, возможно, останется на свободе”, – говорил источник.
