В Минобороны придумали наказание за отказ ехать на военные сборы
В Министерстве обороны РФ предложили привлекать к административной ответственности военнослужащих запаса и резерва за неявку на военные сборы. За нарушение обсуждаемой статьи КоАП предложили ввести штрафы от 10 до 50 тысяч рублей.
На Едином портале раскрытия информации поясняется, что штрафы от 10 до 20 тысяч рублей грозят военнослужащим запаса, отказавшимся посещать сборы. Взыскания от 20 до 50 тысяч предусмотрены для тех, кто заключил контракт и поступил в мобилизационный резерв, но не явился на сборы.
Председатель Военной коллегии адвокатов Владимир Тригнин сказал, что сейчас законодательство не предусматривает никакой ответственности за неявку на военные сборы. Можно уклониться от военных сборов, и это ничем не грозит, сообщает РБК.
По мнению Тригнина, военные сборы необходимы, чтобы поддерживать бойцов запаса в боевой готовности. “Там люди учатся обращаться с новым оружием, использовать новейшие технические разработки, это необходимо, чтобы поддерживать запас в боеготовности”, – сказал адвокат.
Инициатива Минобороны – это продолжение реформы системы резерва, считает член президентского Совета по правам человека, руководитель правозащитной группы “Гражданин. Армия. Право” Сергей Кривенко. По его мнению, высокие штрафы за неявку на сборы будут способствовать повышению “мобилизационной возможности армии”.
Ответственный секретарь Союза комитетов солдатских матерей России Валентина Мельникова сказала, что обсуждать это предложение не имеет смысла до тех пор, пока Минобороны не представит данные о том, сколько резервистов-уклонистов привлечены к ответственности за неявку на сборы, сообщает газета “Ведомости”.
Мобилизационный людской резерв был создан в июле 2015 года указом президента Владимира Путина. После службы в армии или по окончании военной кафедры военнослужащие могут заключить контракт и поступить в людской резерв.
За уклонение от воинской службы по призыву юношу могут привлечь к уголовной ответственности по статье 328 УК РФ и приговорить к штрафу до 200 тысяч рублей или лишению свободы сроком до двух лет. В 2014 году за уклонение от воинской службы были осуждены 775 человек.
