Минстрой предложил ужесточить ответственность управдомов
Гибель или травмы, полученные жильцами на территории своего многоквартирного дома, могут стать причиной отзыва лицензии у управляющей компании (УК), пишет «Российская газета». Ужесточить ответственность за грубые нарушения в их работе предлагают в Министерстве строительства и ЖКХ (Минстрой). Проект по изменению Жилищного кодекса России сейчас проходит общественное обсуждение.
Выгнать управдома могут, например, за падение сосульки или снежного кома с неубранной вовремя крыши, пояснили в ведомстве «Российской газете». Лицензию также отнимут, если житель получит травму на неубранном льду или в неисправном лифте. Полный перечень будет установлен позже специальным «положением о лицензировании». В него войдут и грубые нарушения, которые повлекли смерть или причинение тяжкого вреда здоровью граждан, рассказали изданию в Минстрое.

Чтобы привлечь к ответственности УК, жильцы должны будут обратиться с жалобой в местное отделение Госжилинспекции. В зависимости от тяжести нарушения по результатам проверки будет принято решение либо о штрафе, либо об обращении в суд с требованием отзыва лицензии, пишет газета.
Сейчас нарушения управдомов не делятся на грубые или мягкие, рассказала изданию исполнительный директор НП «ЖКХ Контроль» Светлана Разворотнева. «Если УК получает два административных взыскания (даже за немытые полы) по одному дому, она лишается права управления им. А лицензию отзывают в том случае, если таких домов набирается более 15%. При этом процедура лишения права работы в доме сегодня очень длительная. Судебные слушания длятся бесконечно с учетом того, что управляющие компании подают апелляцию. Пока этот процесс тянется, проштрафившиеся управдомы продолжают рассылать коммунальные счета жильцам. Эту практику надо прекращать», — цитирует Разворотневу «Российская газета».
