Украинский регулятор отозвал лицензию у «дочки» Московской биржи
Национальная комиссия по ценным бумагам и фондовому рынку Украины аннулировала лицензию фондовой биржи ПФТС на осуществление профессиональной деятельности на фондовом рынке, сообщила в среду, 7 октября, пресс-служба кабинета министров Украины. Принятые в конце июня поправки в украинский закон «О лицензировании видов хозяйственной деятельности» позволяют регулятору отзывать лицензии у компаний, которые контролирует резидент страны, «осуществляющей вооруженную агрессию против Украины» или «создающей условия для возникновения военного конфликта».
После принятия поправок украинский регулятор аннулировал лицензии всех брокеров с российскими акционерами, в числе которых оказались два брокера Сбербанка и два — группы ВТБ.
Фондовая биржа ПФТС и Украинская биржа, в которых Московская биржа владеет контрольным пакетом и 43% соответственно, пытались избежать той же участи. Они обратились в национальную комиссию «с просьбой не принимать решения об отзыве лицензии, пока они не завершат процедуры и действий по уменьшению доли участия Московской биржи в их капитале», говорилось в отчетности Московской биржи по МСФО за первое полугодие 2015 года.
Доля Московской биржи в ПФТС оценивается в 16 млн гривен ($750 тыс), в Украинской бирже — в 11 млн гривен ($520 тыс). В конце сентября национальная комиссия сообщила, что получила заявки на покупку украинских активов Московской биржи. На долю в ПФТС претендовали две компании — «Инвестиционный капитал Украина» (ICU) и «Фаворит», но первая согласно заявлению регулятора не смогла предоставить предварительное согласие Московской биржи на продажу акций, а вторая не предоставила информации о наличии у нее средств на приобретение акций ПФТС и о будущих конечных бенефициарах биржи. Не имея «достаточных подтверждений о возможности соблюдения требований законодательства», комиссия решила аннулировать лицензию биржи», говорится в официальном сообщении регулятора.
В отчетности Московской биржи за первое полугодие 2015 года максимально возможный убыток от потери бизнеса на Украине оценивался в сумму, не превышающую 200 млн руб. Представитель биржи ранее говорил, что «любой сценарий по активам на Украине не окажет существенного влияния на финансовые показатели группы «Московская биржа».
ПФТС обращает внимание клиентов и партнеров на то, что «биржа продолжает выполнять свои обязательства перед участниками торгов, эмитентами ценных бумаг, международными информационными агентствами и фондовыми биржами, которые используют данные ПФТС в своей деятельности, поскольку решение НКЦБФР может приобрести в силу не ранее чем через 30 календарных дней и может быть обжаловано в законном порядке, говорится в пресс-релизе ПФТС.
ПФТС — крупнейшая биржа ценных бумаг на Украине. На начало 2015 года на ней обращались 1639 выпусков ценных бумаг, включая акции, государственные и корпоративные облигации, а также инвестиционные сертификаты. Рыночная капитализация компаний, имеющих листинг на ПФТС, составляла более 85,5 млрд гривен (около $4 млрд).
